- In the Terms and Conditions, the following definitions apply:
- “Company” means The Wilder Studios Limited, 98 Belsize Lane, London, NW35BB.
- “Member” means any person that has completed and submitted the online registration form at thewilderstudios.com and whose registration has been accepted by the Company.
- “Studio” means The Wilder Studios at 98 Belsize Lane, London, NW35BB, and includes any virtual services via Zoom or social media channels.
- “User” refers to anyone using the Company’s Website who is 18 years of age or older.
- “Terms and Conditions” means these Terms and Conditions.
- “Website” refers to thewilderstudios.com and any sub-domains of this website unless expressly excluded by their own terms.
- References in the Terms and Conditions to the singular will include the plural and vice versa, and references to gender will include all genders.
- These Terms and Conditions, along with the Company’s Privacy Policy, constitute the entire agreement between the Company and the User or Member in relation to the use of the Company’s Website and the Company’s Studio.
- If any provision of these Terms and Conditions is deemed unlawful or unenforceable by any court or competent authority, the remaining provisions will continue in effect.
- The Company reserves the right to vary and revoke the Terms and Conditions from time to time, which it may consider necessary for the regulation of the Studio and the conduct of Members. Any such changes will be notified to Members and, until revoked, are binding on Members.
- These Terms and Conditions will be governed by the laws of England and are subject to the exclusive jurisdiction of the English courts.
- In the Terms and Conditions, the following definitions apply:
- MEMBERSHIP & GENERAL USE
- Membership Registration: Users must complete the registration process to become a Member. Acceptance is at the absolute discretion of the Company. Members must be at least 18 years old.
- Monthly Membership Billing: Memberships are billed from the date of purchase and auto-renew monthly unless a one month’s written notice of cancellation is provided via email to [email protected].
- If a member books an additional class (including automated bookings from a Waitlist) outside of their class pack or monthly membership contract allocation, the Member unconditionally and irrevocably authorises the Studio to debit any credit or debit card provided by the Member for any outstanding fees without notice to the Member for these additional classes. Members with a rolling contract will be charged at the rate of £25/class. All other members will be charged £35/class. All charges will be taken within 14 days of the class attendance
- Freezing Memberships:
- Monthly Members may freeze their membership twice per year for one billing cycle with 48 hours’ notice before the next payment date.
- Annual members are entitled to freeze their membership twice per 12-month period, for a maximum of one calendar month per freeze. Freezing will extend the end date of the annual membership by the duration of the freeze, with the membership resuming immediately following the freeze period.
- Non-Transferability: Memberships and class credits are non-transferable and cannot be shared with others.
- Medical Emergencies: In cases of medical emergencies, refunds or credit extensions may be provided upon submission of a valid medical note
- STUDIO OPENING TIMES
- Session times may vary. Current schedules will be posted on the website at thewilderstudios.com and at the Studio.
- PAYMENT TERMS
- Session Prices: Details of session and gift certificate prices are available on the Company’s website or directly from the Studio. Prices are subject to change at the Company’s discretion.
- Payment Policy: All sessions must be booked and paid for in advance. Payments for sessions and gift certificates are non-refundable unless otherwise specified.
- BOOKINGS, CANCELLATIONS & CLASS POLICIES
- Booking System: Sessions must be booked through the Member’s personal account on thewilderstudios.com. Classes are booked on a first-come, first-served basis.
- Booking Limitations: Members are limited to booking a maximum of two classes per day, including any sessions booked with a guest pass.
- Late Entry & Class Reallocation: Members who fail to claim their reformer spot within 5 minutes after class start will forfeit their spot. The Studio may reallocate the reformer to another guest without refund or credit.
- Cancellation Policy: Group class cancellations or rescheduling must be made 12 hours prior to the scheduled class. Late cancellations or no-shows will be charged at the single class rate for that membership or £20/class for unlimited membership holders.
- Additional Classes: If a member books an additional class outside of their class pack or monthly membership contract allocation, they authorize the Studio to charge any credit or debit card on file for these additional classes at a drop-in rate of £35 per class, without prior notice. All charges will be processed within 14 days of the class attendance.
- Workshops & Private Classes: Cancellations for workshops, special events, and private sessions must be made at least 24 hours in advance.
- Waitlist: Joining the waitlist does not guarantee a place in the class. If added to a session, the cancellation policies still apply.
- Reformer Spot Release: In the interest of fairness, reformer spots will be released 5 minutes after class starts. If the spot is not claimed within that time, it may be reallocated without a refund or credit.
- GUEST PASSES
- Guest Pass Allocation: Each member may use one guest pass per class to bring a guest to a session.
- Guest Responsibility: Members are responsible for ensuring their guest complies with all studio terms, policies, and etiquette guidelines. Guests are required to complete a registration form and agree to Wilder Studios’ liability waiver before participating.
- Non-Transferable: Guest passes are strictly non-transferable and may only be used by the member’s invited guest for that specific class.
- Cancellation & No-Show Policy: Guest cancellations follow the studio’s regular class cancellation policy. If a guest cancels within 12 hours of the class start time or does not attend, a £20 fee will be applied. The fee will be charged to the member’s account, and the guest pass will be forfeited.
- HEALTH, SAFETY & HYGIENE
- Medical Conditions: By signing up, Members confirm they are in good health and capable of engaging in physical activity. Members must notify the Studio of any pre-existing medical conditions, pregnancy, or injuries.
- Medical Clearance: Members with specific health conditions must provide medical clearance from a licensed physician before participating.
- Use of Equipment: Members must follow instructor safety instructions when using equipment. Members must arrive at least 10 minutes before their first session to receive an induction on equipment usage.
- Members are required to follow the instructions of the teacher at all times.
- Members are not allowed to use any of the Studio’s equipment unsupervised and outside the sessions.
- Injury Reporting: Accidents or injuries occurring on the premises must be reported to a staff member immediately.
- Members shall not be allowed to attend any session whilst under the influence of alcohol or drugs. In the event they do attend, this is entirely at their own risk.
- COVID-19 Exposure: Members are responsible for notifying the Studio if they have been exposed to any contagious diseases, including COVID-19.
- Dress Code: Members are requested to wear a form of dress appropriate to the practice of Pilates. Members should attend sessions barefoot or, if preferred, with grippy socks. Footwear should be removed in the reception area before entry to the changing rooms or the studio.
- Notwithstanding clause 6.6 above, Members must not walk around the Studio barefoot if they have Verruca or similar foot complaints.
- The Studio reserves the right to refuse access to any Member if, at its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of Studio facilities.
- In the interests of safety and hygiene, no crockery, glass, or food is permitted in the changing rooms or studio. Only water is permitted in the Studio.
- Members must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason. In the event of a fire, Members are asked to make their way to the nearest available exit.
- Smoking and the use of e- cigarettes are forbidden in the Studio.
- Safety is a priority. While Members are responsible for using the equipment safely and following instructions, our trained instructors may, when necessary, provide hands-on corrections during classes to ensure proper form and safety. If an instructor observes that you are not using the equipment correctly or are not adhering to their instructions, the Studio reserves the right, as outlined in clause 6.11, to deny further participation in the session.
- By agreeing to these Terms, Members confirm their understanding of how to properly use the equipment and agree to adhere to all safety protocols at all times. Please address any questions or concerns about equipment use or safety before the start of the class, as it may be challenging for instructors to provide individual corrections to every Member during the session. Due to the noise of music, equipment, and other participants, communication may be difficult during class, and it may not always be possible for the instructor to hear or respond to queries in real time.
- PRE/POST-NATAL
- Eligibility: Members who are pregnant or immediately post-natal are welcome to attend classes; however, certain restrictions apply to ensure the safety of both the mother and the child. Prior to participating in group classes, first-time pre/post-natal Members must complete at least one private 1:1 session with an instructor. Returning Members who became pregnant after regular attendance may continue in group classes at their own discretion, but must notify the instructor of their pregnancy.
- Medical Clearance: All pregnant or post-natal Members must obtain medical clearance from their healthcare provider before participating in any classes. Members are responsible for informing the Studio of any health concerns related to their pregnancy.
- Risks & Responsibilities: By participating in any class while pregnant or post-natal, Members understand that physical activity may carry an increased risk of injury to themselves or, if applicable, to their unborn child. Members agree that they are participating voluntarily and at their own risk. The Studio is not liable for any complications arising from participation unless caused by gross negligence.
- Self-Monitoring: Members are responsible for self-monitoring the intensity of their participation in classes. Should any discomfort arise during or after the class, Members are expected to stop the activity immediately and consult their physician or midwife for further advice. The Studio and its instructors are not healthcare professionals and do not assume any responsibility for the medical conditions of pregnant Members.
- Waiver of Liability: By participating in pre/post-natal classes, Members hereby release and hold harmless The Wilder Studios, its directors, employees, and instructors from any claims related to injuries, complications, or other adverse health effects that arise from attending the classes, except where such injuries result from gross negligence by The Wilder Studios.
- Confidentiality: The Studio adheres to GDPR regulations and treats all health-related information, including pregnancy status, as confidential. This information will only be shared with necessary personnel and used for the purpose of ensuring safety during classes.
- STUDIO CONDUCT & POLICIES
- Behaviour: Members are expected to conduct themselves respectfully toward others in the Studio. Disruptive behaviour or failure to follow instructions will not be tolerated.
- Photography & Media: Photography or video recording is prohibited without prior written consent. Members consent to the use of their image for marketing purposes unless they opt out in writing.
- Use of Studio Property: Members are permitted to use the Studio’s property (e.g., toiletries, hairdryers) while on the premises. The removal of Studio property may result in termination of membership and legal action.
- PERSONAL BELONGINGS
- Personal belongings are brought onto the Studio premises at the Member’s own risk and the Company does not accept liability for any loss or damage whatsoever to such items.
- LIMITATION OF LIABILITY
- Assumption of Risk: By participating in classes or using equipment, Members assume all risks associated with physical activity, including injury from improper use of the equipment.
- Availability of Sessions, Teachers, and Equipment: The Wilder Studios cannot be held responsible for any specific session, instructor, or piece of equipment being unavailable for any reason. The Studio reserves the right to make changes to session schedules, instructors, or equipment, including ancillary facilities (such as showers), without prior notice. The Studio will not be liable for any loss or inconvenience caused by such alterations, except where the law prevents the exclusion of liability.
- Member’s Responsibility for Fitness: It is the responsibility of each Member to ensure that they are physically capable of participating in the exercises offered during any program or class. Members acknowledge the risk of injury associated with physical exercise and the use of specialist equipment. Members are advised to seek medical advice before starting any fitness program. The advice provided by Wilder Studios instructors does not substitute for professional medical advice.
- Property and Personal Injury: The Wilder Studios accepts no liability for any loss or damage to a Member’s personal property, or for any injury to Members within the Studio premises or outside the Studio, except where such loss, damage, or injury cannot be excluded by law.
- Waiver of Liability for Participation: By participating in activities or using facilities at The Wilder Studios, Members waive and release the Studio from any and all liability for injuries or damages resulting from their participation in classes or use of equipment, except in cases of death or personal injury caused by the negligence or intentional misconduct of the Studio.
- Force Majeure: The Company will not be held responsible for service interruptions caused by circumstances beyond its control, such as pandemics, natural disasters, or maintenance closures.
- Indemnification: Members agree to indemnify The Wilder Studios and its staff from any claims or damages related to their participation in activities, except where caused by the Company’s gross negligence.
- COVID-19 Assumption of Risk: Despite the precautions taken by The Wilder Studios in line with government guidance, the Studio cannot guarantee that Members will not be exposed to COVID-19, including through contact with equipment, facilities, or other individuals in the Studio. By entering the Studio, Members knowingly and voluntarily assume all risks related to potential exposure to COVID-19, whether known or unknown. The Studio assumes no liability for any COVID-19-related loss, damage, or injury except as required by law.
- Maximum Liability: to the extent permitted by law, The Wilder Studios is not liable for any:
- Losses caused by events outside of its reasonable control.
- Business losses such as lost profits, revenue, contracts, or goodwill.
- Loss or corruption of data or software.
- Special, indirect, or consequential damages.
- Liabilities arising from the use of the website, except as provided by law.
- GENERAL
- Severability: If any clause in these Terms is found to be unenforceable, the remaining Terms shall continue to apply.
- Governing Law: These Terms are governed by the laws of England and any disputes shall be subject to the jurisdiction of the English courts.
- Notice of Address Change: Members are required to notify The Wilder Studios in writing of any change to their postal or email address. In the absence of such notice, all communications sent to the Member’s last known address will be considered received within five days of mailing.
- Right to Refuse Admission: The Wilder Studios reserves the right to refuse admission to the Studio to any Member without providing a reason.
- Assignment of Membership Rights: The Wilder Studios may assign or transfer the benefits and obligations of your membership to a third party at any time without notice.
- Third-Party Rights: No person who is not a party to the membership agreement shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any part of these Terms and Conditions.
- Email Communication: By providing an email address to The Wilder Studios, Members consent to receive communications electronically, including notices under these Terms and Conditions. While the Studio will make every effort to protect the privacy of such communications, it cannot guarantee the security or confidentiality of email communications and will not be held liable for any issues arising from their use.
- Compliance with Studio Guidelines: Members must adhere to all Studio guidelines, which may be updated from time to time. The Studio may issue reasonable instructions to ensure smooth operation, and Members are expected to comply with these directions.
- Ownership of Materials: All marketing, educational, or other materials provided by The Wilder Studios remain the property of the Studio and are protected by copyright law. Members are not permitted to reproduce or distribute these materials without permission.
- USE OF THE WEBSITE
- Acceptance of Website Terms: By using The Wilder Studios website, the User agrees to comply with these Terms and Conditions in full.
- Website Usage: Users must not engage in any activities that may cause harm, damage, or impair the functionality, availability, or performance of the website.
- INTELLECTUAL PROPERTY
- Ownership of Content: All content on The Wilder Studios website, including but not limited to text, graphics, logos, images, sound, videos, and code, is the property of The Wilder Studios or its licensors. The content is protected by applicable English and international intellectual property laws.
- Restrictions on Use: Users are not permitted to reproduce, distribute, store, or reuse any content from the website without express permission from The Wilder Studios.
- LINKS TO THIRD-PARTY WEBSITES
- External Links: The Wilder Studios website may contain links to third-party websites for informational purposes. The Studio is not responsible for the content or services provided by such websites and assumes no liability for any issues that may arise from their use.
- WARRANTIES
- Accuracy of Information: The Wilder Studios does not guarantee the completeness or accuracy of the information provided on its website. The content may not always be up-to-date, and the Studio reserves the right to modify or discontinue the website at any time without notice.
- Website Changes: The Studio may alter, suspend, or terminate any or all parts of the website at its sole discretion, without providing compensation to users.
- GIFT CARDS
- Gift Card Terms: Gift cards issued by The Wilder Studios are valid for redemption within three months of receipt.
